Justice Minister claims that surrogate mother Beata Grzybowska can claim her right to the child she gave birth to, under a newly reformed family code.
Beata Grzybowska’s case has been unprecedented in Poland. The 32-year-old woman from the central city of Lodz signed an agreement a year ago with a childless couple from Warsaw to be a surrogate mother for 30,000 zlotys (about 7,300 euro).
The child had nothing genetically in common with the surrogate mother. After delivery, Grzybowska gave the child to the couple but now she wants it back, explaining that she became attached to it during pregnancy.
According to Polish law, based on the Roman regulation mater simper certa est, only a woman who gave birth to a child is its mother. Thus, Grzybowska can fight for the right to take care of a child in court, claims Justice Minister Andrzej Czuma. The Minister is not sure if the agreement between a surrogate mother and a couple is binding, or whether it undermines the regulation on the protection of human life. Czuma released a statement advising the public to be careful when taking a decision on hiring a surrogate mother. (mg/mmj)
