Kaczynski loses round 2 of ‘health privatisation’ court case

23.06.2010

A Warsaw court has repeated an earlier ruling that presidential candidate Jaroslaw Kaczynski told ‘mistruths’ about Bronislaw Komorowski wanting to privatise Poland’s health service.

The Warsaw Regional Court  ruled on Tuesday that Kaczynski's claim that his rival is looking to privatise health care was not rooted in reality. Kaczynski has been ordered to officially apologize to Komorowski and is not allowed to spread false claims about his rival. The court rejected the Law and Justice’s claim to punish Bronislaw Komorowski for calling Kaczynski a liar.

The rulling follows a similar verdict last week before the first round of presidential elections which saw Kaczynski and Komorowski gaining most votes and therefore will go forward to a second round run off on July 4.

“This is good news. We’re waiting for the ruling to come into force,” said Slawomir Nowak from Bronislaw Komorowski’s electoral staff.

Earlier, Jaroslaw Kaczynski lost the case before the District Court and was trying to convince a higher court that his accusations against Civic Platform’s candidate were grounded.

Jaroslaw Kaczynski’s electoral staff announced that it will appeal, yet again, the ruling. “We accept the ruling but we don’t agree with it,” said Pawel Poncyliusz from Kaczynski’s campaign team.

In 2007, a court ruled that Civic Platform was right claiming that since May 2007 (when it changed its program) it did not intend to privatize hospitals but to “communize” them, to make local authorities responsible for them. (mg/pg)
