Five family members of victims who died in the Smolensk air crash on April 10 have submitted notification to the State Treasury’s Prosecutor’s Office that they intend to sue for damages.
Head of the Treasury Prosecution, Marcin Dziurda told press that the notification is a signal that the case may end up in court, although he underlined that an out-of-court settlement would be possible.
“The sum for damages has not been discussed,” Dziurda reiterated.
The Treasury Prosecution Office is currently drafting the terms of any eventual settlement contracts, although Dziurda has stated that “this case is serious and we have to analyse the status of the plane [that crashed],” adding that the issue concerning the fact that the Tu-154 was technically a military aircraft may have a bearing in the case.
“I will meet with the families at the end of August […] when we receive the analyses, then we will know whether there will be a settlement agreement or whether to take the matter to court,” Marcin Dziurda said.
Rafal Rogalski, a lawyer who represents Jaroslaw Kaczynski, the twin brother of the late president Lech Kaczynski, has stated that neither he nor other family members have been alerted by the Treasury Prosecution as to any developments in the case for compensation.
“There’s an ongoing investigation, the Prosecution is performing its functions, so it’s a little too early to speak of any compensation as of yet,” Rogalski has said, adding that he is not discounting the Treasury Prosecutor’s move. (jb)
