End of MPs’ immunity from prosecution?

The ruling Law and Justice government has announced it is considering a referendum on MPs’ immunity.

“We were inclined to such a motions put forward by [opposition] Civic Platform, even though they are using [the issue] tactically” the head of PiS parliamentary group, Marek Kuchciński, said.

Kuchciński also told journalists that according to Law and Justice there should be a referendum or at least a public debate about the restricting MPs immunity.

This case will be discussed by the party’s Policy Council during its session on Saturday.

Last week, prompted by bribery accusation against a member of the ex-communist SLD opposition, the head of Civic Platform, Donald Tusk, appealed to PiS for immediate work on such an amendment to the constitution that would lift the parliamentary immunity.

PO is proposing to remove from the article 105 of the Constitution concerning immunity. Only one regulation would remain, saying that an MP cannot be detained or arrested without parliamentary consent.
