Poznan prosecutors have closed the investigation into the case of Wioletta Wozna, who claims that a Caesarian section that doctors performed to save Wozna’s life has rendered her infertile.
“It was definitely the damage to the fallopian tube that has rendered the patient unable to have children,” says the Poznan General Prosecutor.
Wozna – known for the court battle over her decision to keep surrogate baby Roza – claims that, while she did sign a consent form to perform a C-section or other medical procedure a life-threatening situation, the C-section procedure damaged her fallopian tubes. Wioletta Wozna says that, as a result, she will no longer be able to bear children.
The woman went into the doctor at 23-24 weeks pregnant complaining of health problems. Doctors then informed Wioletta that a natural birth will not be possible. Wozna then signed a consent form to allow any medical procedure necessary to save her life.
Wioletta brought the case to prosecutors in August claiming that she was “sterilized without consent,” saying that she was only made aware of the fact that she is now sterile upon reading her medical documents after being released from the hospital.
The official stance of the Szamotuly hospital, in western Poland, is that Wozna signed all required consent forms before giving birth.
By law, any person who caused grievous bodily harm (especially related to deprivation of fertility) faces up to ten years in prison if tried and convicted.
Wozna has not yet announced whether or not she will pursue the case further. (mmj)
