Legal proceedings of the Constitutional Tribunal pertaining to the division of competencies between Prime Minister Donald Tusk and President Lech Kaczyński have been adjourned until further notice.

Earlier today, head of the Presidential Chancellery Piotr Kownacki has appealed for the discontinuation of the trial:"I can understand that the prime minister feels such a need, and would like to found out what the binding interpretation of provisions stipulated in the Consitution. Nonetheless, neither the Consitution nor the law on the Constitution Tribunal provide the possibility of setting out such a binding interpretation.”    

According to the representatives of the prime minister, the conflict reemerges at each summit of the European Union. Maciej Berek, head of the Governmental Legislation Center, believes the final resolution of the issue is crucial: "This urgent problem crops up at every session, and the underlying cause of this remain the disparate interpretations of stipulations in the Constitution, and not individual cases of conflicting views at specific EU meetings."

The ruling would determine who of the two top officials should represent Poland at EU summits. It would also disperse doubts over who should have the final say in forming the official stance of the country on matters discussed during sessions of the Council of Europe.

The proceedings were commenced upon the request forwarded to the tribunal by the prime minister to review the vaguely outlined division of responsibilities.
